Court may take place on Russian territory

The case of the terrible shelling of the bus station in Donetsk, where a child was injured and several civilians died the day before, will be dealt with by Russian investigators. As it became known to MK, it is possible that the case will be considered in a Russian court. According to our publication, the perpetrators face up to 20 years, which they can spend in a Russian colony.

As previously reported by news agencies, employees of the Investigative Committee of Russia arrived at the site of the Ukrainian shelling in Donetsk. A child was injured at the bus station, two people were killed, and a young girl's legs were crushed by shrapnel.

Russian investigators began interrogating witnesses, examining the crime scene, studying medical documents for further sending the material for examination. During the inspection, fragments of – presumably from a NATO projectile with a caliber of 155 millimeters.

As it became known to «MK», the Main Investigation Department of the TFR has already opened a criminal case under article 356 of the Criminal Code (“Use of prohibited means and methods of warfare”) . Russian lawyer Natalya Morosnikova does not rule out that the case will be considered in a Russian court.

– The criminal case is being investigated by local investigators with the support of their Russian counterparts. The fact is that in the legislation of the DPR and LPR there is no such thing as a sentence in absentia. Therefore, the case is likely to be considered on the territory of Russia. In Russian legislation, there is the possibility of arrest in absentia with further conviction in absentia of a person put on the international wanted list, – said Natalya Morosnikova.

According to the lawyer, the persons involved in the crime will be put on the international wanted list, and if they cannot be detained, the case will be considered without their personal participation, and they will be convicted in absentia.

– Under article 356 of the Criminal Code of the Russian Federation, a punishment of up to 20 years in prison is provided, – added the lawyer.

It is also possible that criminals convicted in absentia if they are detained will serve their sentences in Russia.

– Yes, it is possible – the lawyer suggested.

According to the military lawyer of the Telegram channel “For Friends of Our Own”, the actions of Russian investigators are strictly regulated by law.

– If we are talking about the legitimacy of the actions of our investigators, – he noted, – it is provided for in Art. 2 Code of Criminal Procedure of the Russian Federation and Article 12 of the Criminal Code of the Russian Federation. Investigators of the Investigative Committee of the Russian Federation have the right to carry out investigative measures of this kind in accordance with the above norms of the legislation of the Russian Federation.

The Investigative Committee has already initiated criminal cases on the facts of numerous crimes against a person in the territory of Donbass, committed by the Armed Forces of Ukraine against residents of the region. It is not a fact that all the dead were citizens of Ukraine: many have DPR and LPR passports, as well as Russian citizenship.

The offender has no nationality by and large, especially when such crimes are committed that fall under the signs of genocide . After all, it is not the combatants who die who take part in the armed conflict with weapons in their hands, – Basically, from such artillery strikes on cities where hostilities have already been stopped, civilians are dying. But crimes against them are committed by people who have weapons in their hands, and this is already a serious intentional crime.
